1. Acceptance of Terms

By accessing and using Extuitive (“the Service”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Extuitive is a platform that connects your Meta (Facebook and Instagram) advertising accounts to the AI assistant of your choice so that you, or that assistant acting on your instruction, can work in those accounts. Our service includes but is not limited to:

• Connecting Meta ad accounts and setting each up as a workspace
• Uploading image and video creative to your ad accounts
• Creating paused campaigns, ad sets, ad creatives, and ads on your instruction
• Reading your campaigns, ads, and performance data to answer questions about your own advertising
• An MCP server that exposes these capabilities to AI assistants you connect

3. User Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Upload malicious code or attempt to compromise system security
• Engage in automated data collection without permission
• Reverse engineer or attempt to extract source code
• Use the service for competitive analysis of Extuitive itself
• Share your account credentials with unauthorized third parties

5. AI-Generated Content and Recommendations

Our service uses artificial intelligence to generate insights, recommendations, and analysis. You acknowledge that:

• AI-generated content is provided for informational purposes only
• Recommendations should be evaluated and verified before implementation
• We do not guarantee the accuracy, completeness, or reliability of AI outputs
• Business decisions based on our analysis are made at your own risk
• Market conditions and trends can change rapidly, affecting the relevance of insights

6. Third-Party Integrations

Extuitive integrates with third-party services, including Meta advertising platforms and the AI assistants you choose to connect. You acknowledge that:

• Third-party integrations are subject to their own terms of service, including the Meta Platform Terms and Advertising Standards for your Meta accounts
• We are not responsible for third-party service availability or performance
• Data shared with third-party services is governed by their privacy policies
• You must hold the rights and permissions needed to connect any third-party account, including each Meta ad account and Page you connect

7. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Extuitive and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit, but grant us a license to use, analyze, and process your data to provide the Service.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Subscription and Billing

Certain features of the Service may require a paid subscription. You agree to:

• Pay all subscription fees on time
• Provide accurate billing information
• Notify us of any billing discrepancies within 30 days
• Accept that subscription fees are non-refundable except as required by law

10. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

11. Limitation of Liability

To the maximum extent permitted by law, Extuitive shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or business opportunities.

12. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

13. Indemnification

You agree to indemnify and hold harmless Extuitive from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users.

You may terminate your account at any time by contacting us or using account deletion features in the Service.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Massachusetts, without regard to its conflict of law provisions.
